A Healthcare Products Company accused a Medical Technologies Company of infringing its surgical fastener patent, despite the obvious differences in design.
The Challenge
It’s not uncommon in patent litigation for a defendant to face a patent holder who is trying to reach beyond the bounds of their claims. In this example, we used dramatic style and exaggerated scale to strengthen the impact of the analogy between intellectual property and real property.
